FINAL PAPER INSTRUCTIONS, GUIDANCE, AND TOPICSYour final paper should be approximately 5 to 7 pages in length (standard 1” margins, double-spaced, and 11 or 12 font) and should fully address the topic you have chosen. You must choose your paper topic from the list at the end of this document—No Exceptions! This assignment is worth 25% of your final grade in the class. Both the Online Writing Assignments and the Term Paper will be graded according to the following criteria:Content: 50% Is your thesis statement clearly articulated and appropriate? Does your paper contain important, relevant, and/or interesting arguments? Do you support your thesis with facts, research, and compelling theoretical discussions? Does your paper adequately address all aspects of the question you have chosen?Organization: 25%Is your paper written in a clear, effective, and organized fashion? Have you introduced and formatted quotations properly? Does your paper contain an introduction, a body, and a conclusion? Do your arguments follow logically? Conventions: 25%Have you proofread your paper thoroughly? Is your paper free of grammatical, spelling, punctuation, and typographical errors? Does it display sentence fluency and appropriate word choice?There are many different ways to format citations, footnotes, and bibliographies. The MLA (Modern Language Association) is the preferred format for papers on legal or constitutional law topics. It is very basic, but will provide a good starting place for student writers who are novices. These suggestions can be applied to the final paper as well as to any essay assignment.INTRODUCTION – State your thesis and/or the purpose of your term paper clearly. What is the chief reason you are writing the paper? Explain briefly the major points you plan to cover in your paper and why your topic is important or interesting.BODY – This is where you present your facts and arguments to support your thesis statement. Remember the Rule of 3: find at least three supporting arguments for each position you take. Begin with a strong argument, then use a stronger one, and end with the strongest argument for your final point. Remember to address fully all aspects of the question you have chosen. CONCLUSION – Restate or reword your thesis. Summarize your arguments. Explain in a logical and compelling manner why you have come to this particular conclusion. BIBLIOGRAPHY – It is expected that you might engage in some research in addition to the assigned textbook and optional readings available on D2L, although extensive research is not required. The term paper is not designed to practice advanced research skills as much as it is an opportunity for you to practice your critical thinking skills through addressing the topics at hand. Make certain that if you use a source in your final paper (whether quoted from directly or not) that you cite sources properly within the body of your paper and list all sources consulted in your bibliography. Please feel free to consult me for advice on additional resources once you have chosen your topic.TERM PAPER TOPICS(You must choose from one of the topics listed below—no exceptions)1. Does public opinion affect the Supreme Court even though the justices are unelected? If so, is the effect a direct one or is it indirect? Choose one of the Supreme Court cases assigned in this class to illustrate your thesis. Explain why you think the Court agreed to hear the case you have chosen. What are the basic facts of the case? What are the relevant precedents? Which elements of the relevant law or laws did the Supreme Court uphold and which did it overturn? What provisions of the Constitution did the Court use to justify its decision? In your opinion, why do you think the Court decided the case as it did and what will be the political ramifications of the Court’s decision?2. The case of Dred Scott v. Sandford (1857) was only the second Supreme Court case to overturn and act of Congress. Discuss the Supreme Court’s ruling in this case with respect to the following: What was the historical context in which this case was decided? What were the basic facts of the case? Did Dred Scott become a free person because he spent a portion of his life in a free state? Was the Missouri Compromise constitutionally valid? Did Scott have the legal right to take his case to federal court? What provisions of the Constitution did the Court use to justify its decision? Were there any dissenting opinions and, if so, what were the basic arguments presented? In your opinion, why do you think the Court decided the case as it did and what were the political ramifications of the Court’s decision? 3. The Supreme Court has gone through a long and cyclical relationship concerning the federal government’s use of the commerce clause. In other words, at some points in history the federal government has been granted wide discretion in its use of the commerce power, while at others it has been “reigned in” by the Court. Using the major cases that we have discussed, explain how the federal government’s power to control commerce has changed from Gibbons v Ogden through Heart of Atlanta Motel. Be sure to include a discussion of the different ways the Court has defined commerce. Finally, in light of the most recent commerce clause cases we have read, what do you think is the current state of commerce clause powers? Why?4. Based upon the separation of powers cases we have read, do you think that the Supreme Court has been more willing to uphold actions taken by Congress or by the president that could be construed as violating the separation of powers? Include in your discussion an examination of both domestic issues and issues relating to foreign relations. Use examples from assigned cases to justify your argument. Finally, explain what you think any possible political ramifications are of the Supreme Court’s separation of powers jurisprudence.5. The modern presidency is generally understood to be very powerful in the area of foreign policy. Although the Constitution provides for a division of power between the president and Congress with respect to the war making powers, there is no question that the president has encroached upon the war making powers of Congress. Discuss the expansion of presidential power in this context with reference to specific Supreme Court cases we have read. Has the Supreme Court attempted to rein in this expansion? Discuss measures—such as the War Powers Resolution of 1973—that Congress has taken to address this expansion. Discuss when and under what circumstances the Supreme Court has sided with Congress or the president.
